What types of disputes can be addressed through arbitration?
Arbitration is a type of Alternative Dispute Resolution (ADR) law that is used in Florida to resolve disputes between two parties. It is a legal process that is administered by a neutral third-party known as an arbitrator. This arbitrator will review evidence presented by both parties and then make a final and binding decision. Arbitration is often used to resolve civil disputes, such as contract disputes, business disputes, real estate disputes, or any other disputes that involve two or more parties. In Florida, arbitration is also used to resolve family disputes, including divorce, child custody, or spousal support. Additionally, arbitration can be used for other non-litigation matters, such as resolving disputes regarding true ownership of a property or dispute over the amount of damages a party may be entitled to. Arbitration can also be used to resolve disputes related to claims of negligence, wrongful termination, defamation of character, or any other type of legal dispute. This form of ADR is often used when parties involved in the dispute are unable or unwilling to take the matter to court. This may be because of the cost of litigation or because the parties do not want to bring the dispute into public view. In all these cases, arbitration can be a cost-effective and private way to resolve the dispute.
