What is the timeline for an arbitration process?
An arbitration process typically follows a specific timeline depending on the complexity of the dispute. Before any proceedings are held, both parties must agree to the arbitration, either through a written arbitration agreement or through a court order. Once the agreement is in place, the arbitrator must be appointed. The parties can either agree on one arbitrator or appoint two arbitrators. In the latter case, the two appointees can choose a third arbitrator who will then become the sole arbitrator. The arbitrator will then set a hearing date. This date must be established before the arbitration process can proceed. In Washington, the hearing must occur within 90 days of the arbitrator being appointed. After the hearing is set, the parties will exchange evidence and other relevant information. They will then appear before the arbitrator on the date of the hearing. During this time, the parties will present their case and the arbitrator will listen to testimony from both sides. Finally, the arbitrator will deliver a decision. This decision is legally binding and the parties must abide by it. A timeline for the decision depends on the arbitrator and the complexity of the case. Generally, an arbitrator needs to deliver their decision within 30 days of the hearing.
