What types of evidence can be presented at an arbitration hearing?

At an arbitration hearing in South Carolina, evidence presented can take a few different forms. Generally, evidence presented in an arbitration hearing can be direct, documentary, demonstrative, or testimonial. Direct evidence could include a video or audio recording that shows the dispute taking place, or a printout or photograph of an agreement in dispute. Documentary evidence could include an agreement or other written document that is relevant to the dispute. Demonstrative evidence could include physical objects or diagrams that relate to the dispute. Lastly, testimonial evidence could include sworn testimony from witnesses to the dispute. During the arbitration hearing, both parties are given an opportunity to present evidence and to object to evidence presented by the other side. The arbitrator makes the final decision regarding the relevance of each piece of evidence and determines whether the evidence should contribute to the outcome of the dispute. Evidence presented in arbitration hearings must be relevant to the dispute and must be obtained legally. Furthermore, it must be presented in a manner that is fair to both sides. If a party fails to present a type of evidence that the party has agreed to present, this could be grounds for an appeal of the arbitration decision.
