What rules govern advertising of alcoholic beverages?
In North Dakota, laws related to the advertising of alcoholic beverages must adhere to the state’s Alcoholic Beverage Control Act. This act outlines several rules governing the advertisement of alcoholic beverages. First and foremost, it is illegal to falsely advertise alcoholic beverages. This means that advertising for any product must be truthful and accurate and not contain any claims or statements that are false or misleading. The advertising should not contain any information which is determined to be unfair or deceptive. Additionally, any advertisement related to the sale of alcoholic beverages must include the phrase “This product contains alcohol and can impair the ability to drive or operate machines.” This is required so that customers are aware of the serious health risks associated with consuming alcohol and the possibility of impaired judgment when doing so. In addition, any advertisement for alcoholic beverages must be appropriate for the intended audience. It must not contain any inappropriate language, images, or suggest any illegal activities such as underage drinking. It is also illegal for any advertisement related to alcoholic beverages to be placed within 500 feet of a school, university, or public playground.
