What are the requirements for advertising to people with disabilities?
Advertising to people with disabilities is subject to specific laws in Florida. The most significant of these is The Americans with Disabilities Act (ADA). This is a federal law which prohibits discrimination in public places, employment, transportation, and other activities. Under the ADA, businesses must make reasonable accommodations for wheelchair access, accessible restrooms, and other reasonable modifications to facilities. This includes advertising to people with disabilities. When creating advertisements, businesses need to be aware of their audience and take steps to ensure their advertisements are accessible. Websites should include features like captioning, audio descriptions, or other features which will allow people with disabilities to view the advertisement. Businesses also may not use language which degrades people with disabilities or belittles them in advertisements. Such language is considered offensive and against the ADA. Any physical advertising should include Braille and meet the technical requirements of the ADA. This includes avoiding visuals or symbols which may be visual or sensory barriers for people with disabilities. Advertising to people with disabilities may require businesses to think more creatively and put in extra effort, but it will ultimately benefit everyone.
