Are there any laws governing the use of pricing information in advertising?
Yes, there are laws governing the use of pricing information in advertising in North Carolina. Businesses must be aware of the information they are using to market and advertise their products. According to the Annotated North Carolina General Statutes, Section 75-1.1, it is illegal for companies to misrepresent prices when advertising. This means businesses cannot falsely advertise prices for a product or service in hopes of gaining an unfair competitive advantage over other companies. In addition, businesses also are not allowed to advertise prices that do not include the full cost of the product or service, such as taxes or fees. This is referred to as "bait and switch," and it is illegal in North Carolina. Additionally, companies must be sure to fully disclose any additional charges that need to be paid in order to obtain the advertised price. They are not allowed to show prices excluding additional charges, and must expressly state all additional costs in their advertisements. Finally, businesses also cannot advertise goods or services with intent to sell them at a price that the seller knows is not available. This means that companies cannot advertise a very low price, for example, as a means of drawing attention to their product, if they do not intend to actually sell it at that price. All prices must be clearly and accurately stated in advertising for goods and services in North Carolina.
