What are the labor laws in agriculture?
In Texas, agriculture labor laws maintain the rights of those who work in the agricultural industry. For example, workers must receive their wages on a regular basis; employers must keep accurate records of how many hours an employee works; and employers must not withhold any wages, including providing the employee their pay stub. Workers are also protected from discrimination and harassment in the workplace. This means that employers cannot treat employees based on their race, color, national origin, religion, sex, age, or disability. Moreover, all workers, regardless of their immigration status, are protected from wage theft and workplace harassment. In addition, farm workers in Texas have unique safety protections. They must be provided with safety equipment, such as protective helmets, safety goggles, and safety vests, and employers must provide them with training in how to use these items. Agricultural workers are also entitled to certain benefits, such as paid sick leave, disability insurance, unemployment insurance, workers compensation, and overtime pay. Overtime pay requires employers to pay workers 1.5 times their regular rate of pay for all hours worked over 40 in a workweek. Finally, agricultural workers are entitled to the same rights as other workers, such as the right to join a union, to file a complaint with the government, and to receive a minimum wage, among other rights. It is important for workers to be familiar with their rights so they can protect themselves.
