What are the laws regulating the use of genetically modified organisms (GMOs) in food production?
In West Virginia, the laws regulating the use of genetically modified organisms (GMOs) in food production are largely centered around labeling. Labeling requirements for products that are or may contain GMOs were passed in 2016, requiring food producers to identify such products on store shelves and packaging. Additionally, the law makes it illegal to label any non-GMO food as being “natural” or “all natural” if it contains a GMO. Tighter restrictions were put in place in 2020 when the West Virginia legislature passed a bill barring West Virginia-based food producers from manufacturing and distributing food that contain genetically modified ingredients. This law does not, however, apply to food that is sold and produced by companies outside of West Virginia. Additionally, in 2021, the West Virginia Senate passed a bill prohibiting any food producer in the state from labeling their products as “GMO-free” or “non-GMO” without meeting a certain set of requirements that have been established by the state. This law requires that producers are able to demonstrate that their product meets the requirements of a “GMO-free” or “non-GMO” food in order to receive this label. Overall, West Virginia’s laws governing the use of GMOs in food production have been largely focused on labeling in order to give consumers information about what is in their food. This is important in order to protect consumers from any potential health risks that may be associated with eating GMO-containing food, and to ensure that consumers have the opportunity to make informed decisions when it comes to their food choices.
