What are the laws regarding agricultural workers’ rights?

In Virginia, agricultural workers have several rights protected by the law. State and federal labor laws provide agricultural workers with rights, including minimum wage and overtime pay; the right to organize and join unions; protection from discrimination and harassment in the workplace; and the right to safe and healthy working conditions. The state of Virginia has specific laws regarding the minimum wages agricultural workers must receive. According to the Virginia Department of Labor and Industry, agricultural workers must be compensated at least the same amount as the state’s minimum wage, which is currently $7.25 per hour. Additionally, agricultural workers must receive overtime pay for any hours worked beyond 40 hours per week. The Virginia Human Rights Act prohibits employers from discriminating against workers based on their race, color, religion, sex, national origin, age, and disability. Additionally, workers in Virginia can organize and join unions to protect their rights. Lastly, agricultural workers in Virginia are entitled to safe and healthy working conditions. The Virginia Occupational Safety and Health Program ensures employers provide a workplace free from hazards that could cause death or serious physical harm to its employees. It also requires employers to provide adequate safety training and the necessary tools and equipment for workers to do their jobs safely.
