What are the laws governing the sale of products labeled as “organic”?

In West Virginia, there are laws in place to ensure that products labeled as “organic” are honestly and accurately identified as such. According to the West Virginia Department of Agriculture, organic products must meet the standards set forth in the Federal Organic Foods Production Act (OFPA). This Act requires a product to contain at least 95% organic ingredients to be labeled “organic” or “made with organic ingredients.” Furthermore, any products that are labeled as organic must be produced and handled in accordance with these standards. Organic products must be produced without the use of synthetic fertilizers, sewage sludge, irradiation, or genetically modified organisms. In addition, organic products must be grown and processed in a manner that protects the environment and conserves natural resources. Organic farmers must also prove that they are using organic practices by keeping detailed records and following a plan laid out by a certified organic certifying agent. In order to sell or market products labeled as organic, a seller must obtain a certificate of organic certification from an accredited certifying agent. Furthermore, sellers must have the proper permits, licenses, and labels in accordance with the standards set forth by the OFPA. Lastly, the West Virginia Department of Agriculture can investigate complaints and take appropriate action if it finds that an organic product does not meet the standards set forth in the OFPA.
