What are the requirements for airspace use?
In North Dakota, airspace use is regulated by the Federal Aviation Administration (FAA) and refers to the air around airports and any other areas where aircraft may be operating. Airspace use is regulated for the safety of both aircrafts and pilots. The FAA requires that all aircraft operating in the airspace must have an operational transponder and comply with current air traffic control (ATC) clearance. An ATC clearance is required for any aircraft flying within five nautical miles of any airport, as well as for any area where aircraft are operating in close proximity to each other, such as an airport pattern. In addition, the FAA requires that all aircraft operating in the airspace must be operated by a licensed pilot and must adhere to air traffic rules and regulations. This includes following the appropriate airspeed limits, operating only within designated airspace areas, and following the rules of the aircraft’s airworthiness certificate, which includes maintaining a minimum altitude of 500 feet above ground level and a visual line-of-sight to the aircraft at all times. Finally, the FAA requires that all pilots must obtain weather briefings prior to entering the airspace and must keep updated on any changes to the weather conditions. This includes registering with the FAA to receive weather advisories and constantly monitoring the weather conditions while in the airspace. This helps to ensure the safety of the aircraft and pilot.
