The legal framework for aircraft hijacking is governed by state and federal law in North Carolina. The federal law concerning aircraft hijacking is the Aircraft Hijacking Act of 1961, which makes it a federal offense to unlawfully seize or exercise control of an aircraft in service. In addition, any person who puts another person in apprehension of bodily injury through the use of a dangerous weapon is liable for up to life in prison. At the North Carolina state level, aircraft hijacking is considered an especially serious offense. If someone is convicted of hijacking an aircraft or committing an act of violence associated with the hijacking, they may be sentenced to a minimum of 20 years in prison, and potentially as much as life. They will also be required to pay any costs associated with grounding the aircraft and any necessary rescue or emergency response services. Under North Carolina state law, a person may also be found guilty of aiding and abetting an aircraft hijacking. This includes providing financial support or means of transportation for someone committing an aircraft hijacking, or transporting a person who has already committed a hijacking. If found guilty of aiding and abetting, a person can face a maximum of 15 years in prison. In addition, North Carolina imposes civil liability on anyone convicted of aircraft hijacking. This allows the victims of a hijacking, or their families in the event of a fatality, to seek compensation for any expenses incurred or emotional distress caused by the hijacking.
