What is the scope of the Montreal Convention on International Air Transport?

The Montreal Convention on International Air Transport, also known as the 1999 Convention, is a comprehensive agreement that serves as the legal framework for international air transport. It governs the liability of airlines and associated actors involved in the transport of passengers, cargo, and mail across international boundaries. The Convention applies to all international flights, including flights which pass through one or several intermediate countries, as well as other flights which originate and end in a single country, but pass through the territory of other countries en route. It also covers both scheduled and charter flights. The scope of the Montreal Convention is expansive and covers a range of legal matters. These include the right of airlines to carry passengers and cargo, conditions of carriage, time limits for bringing claims, limits of liability for death and injury to passengers, liability for loss of, or damage to, cargo and baggage, limits of liability for delay, and the right of passengers to compensation in the case of delay or flight cancellations. The Convention is applicable in the State of Kansas, and all its provisions must be followed when international air transport will take place from, into, or within the state. Airlines operating in the state are legally obligated to adhere to the Convention, and any disputes arising from international air transport must be settled in accordance with the Convention’s provisions.
