What is the scope of the Montreal Convention on International Air Transport?
The Montreal Convention on International Air Transport, commonly referred to as the Montreal Convention, is a multilateral treaty that governs the liability of air carriers for international carriage of passengers, baggage, and cargo. This treaty applies to almost all international air transport that involves two or more countries, apart from those which are subject to national or regional agreements that fulfill the same purpose. The Montreal Convention determines the duties and rights of carriers, passengers, and other involved parties in the event of damage or accidents caused by international air transport. For instance, the Convention sets out the liability of airlines for compensation when passengers are injured during international flights, and also establishes a system for handling baggage claims. In addition, the Montreal Convention sets out the standards for international air transport, such as the safety measures that are to be taken to ensure the safety of passengers and cargo, and the companies’ responsibility for compensating passengers for delays or cancellations of flights.
