What rights do airlines have in aircraft liability cases?
When a person is injured in an aircraft accident in Texas, the airlines involved have certain rights. Airlines are protected by federal laws, including the Airline Deregulation Act of 1978, which states that airlines must be held to a “standard of care” and are not held liable for “acts of God” such as bad weather. Additionally, airlines can limit the amount of money they are liable to pay to the injured party, called “limits of liability”. This means that a panel of six people, chosen by the court, will hear both arguments from the airline and the injured party and decide which party is liable. The jury’s decision is final and can only be overturned if it is found to be unreasonable or the result of a legal mistake.
