What factors are considered when awarding alimony?
In Kansas, there are a few factors that courts consider when awarding alimony. These factors include the length of the marriage, the age and health of both parties, the earning capacity of both parties, the amount of marital property awarded to each party, the parties’ standard of living during the marriage, and the income-producing capacity of any property awarded to each party. When awarding alimony, the court looks at the need of one spouse to receive support, as well as the other spouse’s ability to pay support. In calculating the amount of alimony, a court considers the financial needs and resources of each party, as well as their earning capacities and potential earning capacities. The court also looks at the standard of living each spouse enjoyed during the marriage and how much each spouse contributed to the marriage financially and non-financially. The court may also look at any other relevant factors, such as the spouse’s educational level, prior marriages or the fact that one spouse stayed at home to care for the children during the marriage. The court may also look at the fact that one spouse’s career was limited or stalled as a result of the marriage or that the spouses’ financial resources were squandered during the marriage. All of these factors are taken into consideration when the court determines the amount of alimony to be paid.
