Does alimony have to be included in a divorce settlement?

In Arkansas, alimony must be included in a divorce settlement. Alimony, also known as spousal support, is a payment from one spouse to another to help support that spouse if the couple cannot agree on a settlement that adequately provides for both. This payment is generally provided as a part of the divorce settlement to help the spouse transition into life after the divorce. The amount, types, and duration of alimony is determined by the court and considered part of the divorce settlement. There are four different types of alimony that can be awarded in Arkansas: temporary, rehabilitative, lump sum, and permanent. The court will consider many factors when determining which type of alimony to award, including the length of the marriage, the contribution of each spouse to the marriage, the earning potential of each spouse, and whether or not one spouse was the primary breadwinner. If the court determines that alimony is appropriate, the amount of the award must be included in the divorce settlement agreement. In addition, the court will also consider the length of time for which alimony should be paid. Once alimony is awarded with the divorce settlement, it is considered a part of the agreement, and it is the responsibility of each party to follow through on the agreement.
