When does an alimony obligation begin?
In Texas, an alimony obligation begins when a court officially orders it during the divorce proceedings. The court has the discretion to order one spouse to pay alimony to the other spouse if it finds that one of the parties needs financial support after the end of the marriage. Texas law states that in order to be eligible for alimony, the spouse must have the need for financial support. The court will assess the financial positions of each spouse and make a determination as to whether one spouse will have to pay the other for financial support. The court will also consider whether the paying spouse has the ability to provide support. If the court orders an alimony payment, the paying spouse is then obligated to make monthly payments to the receiving spouse. The amount of the payments will depend on the discretion of the court and based on the financial situation of each party. The court may also set a termination date for the payments. Alimony obligations are separate from any other support or property division settlements that may be ordered during the divorce proceedings. The court may also order the payment of attorney’s fees, or require one spouse to pay ongoing medical expenses of the other. All of the terms of the alimony and other settlements will be included in the final divorce decree.
