Is there a time limit for requesting an alimony modification?

In Louisiana, there is a time limit for requesting a modification of an alimony order. Generally, a party must file a petition within two (2) years of the original alimony award. The court will review the petition and may take into account a substantial change in circumstances since the original award was entered. Some examples of a substantial change in circumstances include job loss, retirement, illness, remarriage, or a change in the dependent’s needs. The court may also consider any other factors it deems relevant in determining whether to modify the alimony award. Additionally, the court may order a temporary suspension or reduction of an alimony award if financial hardship has occurred due to a temporary inability to make payments. The court considers the length of the period of inability to pay and if it is expected to continue. In order to modify an alimony award, the party who is requesting the change must prove a substantial change of circumstances has occurred since the original award was entered. The court will make a determination of what constitutes a substantial change and decide if a modification is appropriate.
