Is there a time limit for requesting an alimony modification?
In Kansas, alimony modification requests must be made within two years of the date the original order was entered. This two-year period is known as the “filing period” and begins from the date the original order was entered into. During the filing period, the court can modify the existing alimony order based on the circumstances of the parties since the order was entered. There are two ways to request an alimony modification. The first is for either party to file a motion with the court asking the court to modify the previous order. The motion must show a material change in circumstances since the original order was entered that justifies a modification. The other way is by agreement of both parties. If both parties agree to modify the order, they can file an agreement with the court. If you miss the two-year filing period, you may still be able to modify the alimony award, depending on the circumstances of your case. You can ask the court to extend the filing period if you have a good reason for missing the deadline, such as if you were not aware of the modifiable change in circumstances or if you were prevented from filing due to circumstances outside of your control.
