How is alimony affected by cohabitation?

Cohabitation is a major factor when it comes to alimony law in Maine. In most cases, cohabitation occurs when the receiving spouse begins a romantic relationship with a new partner and begins living with them. When a spousal recipient has begun cohabitating in Maine, it can impact the amount of alimony received. The courts may choose to reduce or terminate alimony payments if it is found that the recipient is receiving support from a new partner. In order for alimony to be affected by cohabitation, the paying spouse must take legal action and present evidence to prove that the other partner is providing enough financial support to the recipient for them not to need the alimony. Factors such as the length of the relationship, the amount of financial contribution, and other evidence of support will be considered when deciding if alimony should be reduced or terminated. If the court finds that the recipient no longer needs the alimony payments, the court will take steps to reduce or eliminate them. However, if the court finds that the recipient still needs the alimony payments, then the court will continue the payments without interruption. This is the case in Maine for alimony and cohabitation. In order for alimony to be affected, the paying spouse must provide legal proof that their former spouse is no longer in need of financial support.
