What happens to alimony if the payor dies?

When the payor of alimony dies in California, the payments usually end. This is because the courts in California seek to protect the recipient of the alimony payments and do not want them to experience a sudden loss of income. There are some exceptions to this rule depending on the circumstances. For example, if the payor had an insurance policy in place that provided for continued alimony payments in the event of death, then the recipient could still receive alimony payments even if the payor has died. In addition, if the court orders that alimony payments should continue even if the payor dies, then those payments will still be made. Additionally, in some cases, alimony payments can transfer to a payor’s estate or be replaced with other assets from the estate. In this situation, the recipient would receive money or other assets in place of the original alimony payments. Finally, alimony payments can continue if the deceased payor’s will or trusts provide for continued payments. The court must approve the trust or will before the recipient can begin to receive payments. Overall, the court’s main goal is to provide for the recipient in the event of the payor’s death. If there are any special circumstances, the court will consider them before deciding whether to end or continue alimony payments.
