Is alimony modifiable after the divorce is finalized?

In Washington, the answer to whether alimony payments are modifiable after a divorce is finalized depends on the type of alimony. Generally, alimony falls into two categories: rehabilitative and permanent. Rehabilitative alimony is typically awarded to provide a spouse with the opportunity to become self-sufficient. This type of alimony can be modified based on the needs of the receiving spouse and changes that occur in either party’s financial circumstances. Permanent alimony, however, is awarded when one spouse is unable to become financially independent or when one spouse has made significant financial or other contributions to the other’s career. This type of alimony cannot be modified. Neither party can ask for an increase or decrease in payments based on any changes in circumstances (to their financial situation or otherwise). In some cases, a court may even order a buyout of the alimony obligation. Ultimately, if a court awards a spouse with permanent alimony, then that obligation remains in place unless the court orders an end to the payments. If a court awards rehabilitative alimony, then the court may be willing to modify the alimony award if there is a change in the circumstances of either party.
