Is alimony calculated differently if the parties were married for a short period?
In Louisiana, alimony is calculated differently for marriages that last less than 10 years when compared to those lasting 10 years or more. For marriages lasting less than 10 years, the court has the discretion to award alimony or not, and if so, for how long and the amount. The court looks at different factors to decide if an award of alimony is appropriate, including the income of each party, length of the marriage, age of the parties, education level, health and earning capacity of each individual, contributions of each party to the marriage, and other relevant factors. The court also looks at the needs of the spouse who is requesting the alimony and the other spouse’s ability to pay the alimony requested. The court may award alimony payments for a shorter period of time, and money may be paid both in a lump sum or as periodic payments. In some cases, the court may even order that the payments may be paid until the recipient spouse remarries. In general, alimony awards for marriages of a short duration will be lower than those for marriages of longer duration because the length of marriage plays a role in the court’s decision. Additionally, alimony payments may not be required if the marriage was only short-term, as the court may find that the parties did not accumulate any significant property or assets or have any need for maintenance support. Therefore, it is important that couples seek proper legal advice when considering alimony.
