Are alimony payments considered marital assets?

In Washington State, alimony payments are not considered marital assets. Alimony payments are money that a court orders one spouse to pay to the other spouse in order to help that spouse live financially. All marital assets, on the other hand, are assets that are acquired during the marriage. This could include income, property, and investments. Alimony payments do not become an asset of either spouse. Instead, alimony is paid from one spouse to the other, and it is not shared between the spouses like a marital asset would be. Additionally, alimony payments are usually temporary, and the receiving spouse must usually use the money for specific living expenses. This is different from a marital asset, which can be used for anything. Lastly, alimony payments are tax-deductible for the person who is paying them. However, alimony payments are not considered taxable income by the person who is receiving them. This is another way in which alimony differs from a marital asset. For these reasons, alimony payments are not considered marital assets in Washington State or anywhere else in the United States. Alimony payments are their own type of financial support that is meant to help the receiving spouse financially.
