Can alimony be awarded based on need after a long-term marriage?
In Oklahoma, alimony can be awarded to a party in a long-term marriage if they can show a need for it. Though Oklahoma does not provide any specific guidelines for determining alimony, courts have generally considered factors such as how long the marriage lasted, each spouse’s financial situation before and after the divorce, each spouse’s income and earning potential, and each spouse’s standard of living during the marriage. The need for alimony is established when a party can show that they are unable to support themselves after the marriage has ended. To be eligible, the party must have been married for at least 10 years and must demonstrate that they lack the financial means to support themselves without the help of the former spouse. They must also show that their former spouse has the ability to pay alimony, and that the amount requested is reasonable in accordance with the spouses’ standard of living during the marriage. In Oklahoma, alimony is generally awarded in the form of periodic payments for a set period of time. The court may also order the paying spouse to make a lump sum payment or reimbursement for certain expenses, such as educational costs or medical bills. Alimony may also be modified after the divorce if a party’s circumstances change. In such cases, the court may alter the amount of alimony or even terminate it altogether.
