What are the requirements for an alimony agreement?
In Arkansas, an alimony agreement requires the paying party to provide financial support to the other party in the divorce. In order to be eligible for alimony, both parties must have been legally married for a certain period of time. Furthermore, the party requesting alimony must be able to demonstrate that they are unable to support themselves financially due to a physical or mental disability, or due to circumstances that prevent them from earning a sufficient livelihood. The court also considers the paying party’s ability to make payments, as well as the receiving party’s need for support. Factors such as the length of the marriage, the standard of living during the marriage, the parties’ earning capacity, and the parties’ ages, health, and educational background are also taken into consideration. The type of alimony that will be granted, and the amount that will be paid, is determined on a case-by-case basis and depends on the facts of each situation. Generally, alimony is either paid on a permanent or rehabilitative basis, or may be a combination of both. Permanent alimony is paid until the receiving party remarries or one of the parties dies, while rehabilitative alimony is paid for a limited period of time in order to allow the receiving party time to become self-supporting.
