Can alimony be awarded if the couple was never married?

In California, alimony can be awarded even if a couple was never married. This is referred to as “palimony”, which was made well known in the 1970s when actor Lee Marvin sued his former lover for financial support. In California, alimony is based on the principle of equity. This means that the court will use its discretion in deciding how to ensure that both parties receive a fair outcome. In order for palimony to be awarded, the couple must have cohabited for a certain period of time; however, there is no set length of time that is required. Also, it must be proven that the couple had an agreement in place, usually one filed with the court, which outlines their mutual understanding of the division of labor, property, and/or finances. If palimony is awarded, it may be paid in monthly payments over an extended period of time, or it may be paid in a lump sum. In some cases, the amount and length of the payments can be modified or revoked if circumstances change. Generally, palimony cases are highly complex and it is best to consult an attorney if you think you may be entitled to, or liable for, alimony. It is also important to note that alimony laws vary by state, and some states have outlawed palimony expressly or have other restrictions in place.
