How are alimony payments affected if the payor's income increases?

In Arkansas, alimony payments may be adjusted if the payor’s income increases. This is done by filing a Petition to Modify the alimony award with the court. If the payor’s income increases, the court can decide to reduce the amount of alimony being paid. The amount of the adjustment depends on the specific circumstances, such as the amount of additional income the payor is receiving and the amount of alimony that is already being paid. The court may consider a number of factors when determining how to adjust alimony payments. This includes the amount of additional income, the payor’s ability to pay the additional amount, the impact of the additional income on the payee’s ability to support himself or herself, and any changes in the payor’s financial circumstances. The court could also take into consideration any agreements that were made between the parties when they originally entered into the alimony agreement. It is important to note that the court does not have to adjust alimony payments just because the payor has an increase in income. The decision to modify the payments lies solely with the court and it is important to remember that the court will base its decision on what it considers to be the best interests of both parties.
