Does alimony terminate if the payor remarries?

In Louisiana, alimony terminates if the payor remarries. The courts take the position that, as the recipient’s financial need has been satisfied by the payor’s new marital partner, the payor should no longer be responsible for providing alimony. If the payor remarries, they are still obligated to the payments until the remarriage. Once the remarriage takes place, the payor should file a motion with the court to terminate the alimony order. The court will then review the circumstances, and if the court finds that the payor’s circumstances have been materially changed by the remarriage, they will terminate the alimony order. In some cases, it may be possible for alimony to continue after the payor’s remarriage. If the court finds that the payor’s obligations to the recipient have not been fully satisfied, they may decide that alimony should continue in order to adequately provide for the recipient’s needs. The court will also consider whether the recipient is able to become financially independent from the payor.
