Does alimony have to be agreed upon by both parties?

In Pennsylvania, alimony has to be agreed upon by both parties as this is state law. If the two parties cannot agree to alimony, then they will have to go to court and a judge will decide what amount of support is to be paid. The court will assess the incomes and expenses of both parties, along with other factors such as the length of the marriage, the standard of living during the marriage, and each person’s earning potential before making a decision. In some cases, the court will order a one-time, lump-sum payment of alimony. This type of payment can often be negotiated between the parties if both parties agree. However, the court will not approve this type of agreement if it is not considered to be in the best interests of both parties. Alternatively, the court may order periodic alimony payments to be made on a regular basis. In all cases, the court will require that both parties cooperate in determining the amount of alimony that is to be paid. If both parties are unable to reach an agreement, the court can force one party to pay alimony to the other, without requiring their agreement. However, alimony is typically granted upon agreement between the two parties and is intended to be mutually beneficial.
