What are the restrictions on investing in certain countries?
In Florida, investing in certain countries is regulated through Alternative Investment Law. The law states that investors cannot purchase any kind of security issued by a country that is under a U.S. embargo, such as Cuba. Additionally, investment in certain countries may need additional guidance from the U.S. Office of Foreign Assets Control (OFAC) to ensure that the investment does not conflict with U.S. policy. Apart from the embargo-related restrictions, Alternative Investment Law also requires investors to obtain an alternative investment license from the state of Florida before being allowed to invest. This license can be obtained only through the Florida Department of Financial Services and requires investors to pass a background check. Furthermore, Alternative Investment Law considers any investment in countries that are considered to be non-compliant with global anti-money laundering standards to be illegal. As such, any investments in these countries must be done with the explicit approval of the Financial Action Task Force. Finally, investors are prohibited from investing in countries that the U.S. government considers to be dangerous or unable to provide a safe investment environment. This could include countries with a history of violence, political unrest, or corruption.
