In North Carolina, there are laws that protect animals from cruel and inhumane treatment. The state’s Animal Protection Act is an umbrella law that covers many aspects of animal cruelty. The act, which is also known as the North Carolina Animal Welfare Act, makes it illegal for anyone to torture, torment, needlessly mutilate, or cruelly kill an animal. The act also prohibits animal fighting, abandonment of animals, and failure to provide an animal with necessary medical care or sustenance. Additionally, the act makes it illegal to keep an animal in a cage that is too small, to carry an animal in an unsafe manner, and to transport an animal in an improperly ventilated vehicle. The North Carolina General Statute section 14-360 also makes it illegal to willfully or wantonly inflict unnecessary pain to an animal, to abandon an animal, or to fail to provide an animal with necessary medical care or sustenance. Animal cruelty in the state is punishable by up to 150 days in jail and/or a fine of up to $2,500. Subsequent convictions of the same offense can carry even harsher penalties, depending on the severity of the cruelty. The North Carolina Department of Agriculture and Consumer Services is responsible for monitoring and enforcing cruelty laws throughout the state. It also provides guidance to local law enforcement agencies on how to recognize and report animal cruelty, and encourages citizens to report any suspected cruelty.
