In North Dakota, there are laws that protect animals from being used for religious sacrifice. However, the NDCC does recognize the traditional rights of North American Indian Tribes in North Dakota, and allows the tribe to practice its traditional religious rituals, so long as the rituals do not include the sacrifice of an animal or bird that is under the care of a non-indigenous person, and the animal or bird is released alive and unharmed when the religious ritual is complete. This includes not only the rights of the tribe, but also any Native American that is not a member of a tribe. Overall, North Dakota’s animal rights laws do not allow for the sacrifice of animals, except for Native American’s traditional religious ceremonies, so long as the animal or bird is not in the care of a non-indigenous person and is released unharmed and alive.
