What antitrust laws are specific to the US?
In the United States, antitrust laws are those laws that help protect fair competition by preventing corporations from gaining too much power. The three main antitrust laws that apply to the whole United States are the Sherman Antitrust Act, the Federal Trade Commission Act, and the Clayton Antitrust Act. The Sherman Antitrust Act, which was passed in 1890, is considered to be the first major federal antitrust law. It prohibits contracts and combinations in restraint of trade between competing businesses and bans monopolies. The Federal Trade Commission Act was established in 1914 and established the Federal Trade Commission (FTC). This act gave the FTC the power to investigate and take action against companies that are in violation of antitrust laws. The Clayton Antitrust Act, passed in 1914, prohibits certain types of business mergers and acquisitions that would create or maintain a monopoly and makes certain discriminatory prices or practices unlawful. In addition to these federal antitrust laws, states have their own antitrust laws that are specific to them. For example, the Nebraska Antitrust Act of 1984 states that it is illegal to fix prices or otherwise restrain trade and prohibits certain types of exclusive dealing arrangements. It also makes it illegal for two or more companies to enter into an agreement to indirectly fix prices or restrain trade. These laws help to ensure that Nebraska businesses and consumers are protected from anti-competitive practices and they promote competition and fairness in the marketplace.
