What is fraudulent conveyance?

Fraudulent conveyance is a type of asset protection law that prohibits people from transferring property to another person in order to avoid debt or legal liability. Under fraudulent conveyance laws, such transfers are considered fraudulent and can be invalidated by a court. In Louisiana, fraudulent conveyance is defined as any transfer of real or personal property, including money, made with the intent to defraud or hinder creditors. This includes transfers made with the intent to avoid or delay payment of a debt, or to make it more difficult for creditors to collect what is owed to them. Fraudulent conveyance can also include transfers made with the intent to conceal or hide property from the creditors. Louisiana state laws require that an assertion of fraudulent conveyance must be made within three years of the date on which the transfer was made. Additionally, if a transfer of real or personal property was made after a lawsuit had been filed, or a judgment rendered against the transferor, the court is more likely to find that the transfer was fraudulent.
