What is the role of a trust protector?
A trust protector is a person or entity responsible for overseeing the trust set up by a trustor. The role of the trust protector is to ensure the trust is being operated properly and in accordance with the wishes of the trustor. In Washington, a trust protector has several responsibilities. The trust protector must keep up-to-date records of the trust assets and make sure they are being managed correctly according to the trustor’s wishes. Trust protectors can be asked to remove or replace a trustee, if appropriate, and should investigate any conflicts of interest that may arise. Trust protectors must also be informed when the terms of the trust are changed or the trustor is incapacitated and can exercise their right to sue if they believe the trust is being mismanaged. Trust protectors have the power to approve or reject any proposed changes to the trust. Trust protectors are also responsible for making sure the trust assets are protected from creditors and/or lawsuits. This is known as asset protection, and it is an important part of any trust to ensure the trust assets are kept safe from outside influences. Trust protectors are often used in Washington as part of an estate planning strategy. By setting up a trust with a trust protector, the trustor can be sure that his or her wishes are carried out and the trust assets are safe even if something happens to the trustor in the future.
