How do I appeal a court decision?
Appealing a court decision in Michigan can be a complex process. Generally speaking, you must first file a Notice of Appeal with the court that made the decision. The court will then set a date for oral argument on the appeal, at which point both sides present their arguments to the court. After oral argument, the court will make a ruling on the appeal. Michigan’s appellate process is divided into two courts: the Michigan Court of Appeals and the Michigan Supreme Court. Appeals to the Court of Appeals must be approved before being considered by the court. If the Court of Appeals upholds the original court’s decision, the case can proceed to the Michigan Supreme Court. In order to make an appeal to the Michigan Supreme Court, you must file an application for leave to appeal. This application must set out your legal arguments as to why the Court of Appeals ruling should be overturned. The Michigan Supreme Court considers these applications before deciding whether to hear the case.
