How do I appeal a court decision?
Appealing a court decision in Nebraska can be a complicated process. An appeal is a request for a higher court to review a lower court’s decision. Before beginning the appeal process, it is important to remember that appeals are generally only successful if the court made a legal error or committed a miscellaneous procedural error. To begin the appeal process, a Notice of Appeal must be filed within 30 days of the lower court’s decision. This Notice must be filed with the Appellate Clerk of the Nebraska Supreme Court and/or the Clerk of the District Court. In addition, copies of the Notice of Appeal must also be given to all parties involved in the case. The appellant (the party initiating the appeal) must also submit a brief to the Appellate Court. This brief must set out the elements of the appellant’s case that the court made a legal or procedural error in ruling on the case. It is important to remember that the appellant has the burden of proof in showing that the lower court’s decision was wrong. After the filing of the Notice of Appeal and the brief, the Appellate Court may schedule oral arguments. At these arguments, the parties involved in the lower court case can make their arguments, and the Appellate Court will issue a final decision. Appealing a court decision in Nebraska is a complex process and involves multiple steps. It is important to obtain the advice of a qualified attorney to ensure that all deadlines and requirements are met and that the best argument is put forward before the Appellate Court.
