What is the process for filing an appellate brief?

An appellate brief is a legal document filed with an appeals court to present the arguments in a case. In West Virginia, the process for filing an appellate brief is similar to other states in the U.S. The party appealing (the appellant) must first file a notice of appeal, informing the court of their intent to appeal the decision. Once the court receives the notice of appeal, the appellant must then file a brief in which they present their arguments as to why the lower court’s decision was incorrect. The appellate brief must include a description of the facts of the case as well as the applicable law. The appellant must also include citations to relevant cases and other legal authority. The brief must provide a logical, well-organized argument as to why the court should side with the appellant’s position and overturn the lower court’s ruling. Once the brief is filed, the opposing party (the appellee) will have an opportunity to file a brief in response. Both the appellant and the appellee may then present additional arguments and evidence in oral argument before the court of appeals. After all parties have had their say, the court will typically issue a written opinion, either ruling in favor of the appellant or affirming the lower court’s decision.
