What is the time period for filing an appeal?
In Delaware, the time period for filing an appeal depends on the type of case and court it is in. Generally, the deadline for filing an appeal in a civil case is 30 days from the date of the judgment or final order from the lower court. In criminal cases, the period is usually 10 days. In both civil and criminal cases, if a motion for new trial or other procedural matters need to be decided, the deadline for filing an appeal extends to 21 days after the decision is made on those matters. For appeals from the Family Court, the filing deadline is 20 days from the date of the judgment or order. For Delaware Superior Court appeals, the deadline is generally 20 days from the entry of final judgment or order, but 21 days if the lower court enters an order denying a motion for new trial. If a timely appeal is not filed, the lower court’s decision or order will become final and there will be no further appeals from that court. However, people may still be able to file a motion for relief if there was a mistake made in the lower court.
