How does an appellate court decide a case?

An appellate court decides a case by reviewing the decisions of a lower court. The appellate court examines the legal arguments presented by both sides, reviews the evidence presented, and considers applicable legal precedents. The appellate court will then issue a decision that either affirms or reverses the lower court ruling. When reviewing a case, the appellate court will decide whether the lower court made an error in its interpretation and application of the law. The appellate court will consider the facts of the case and determine whether any errors or mistakes were made by the lower court in its judgment. If an error or mistake was made, the appellate court has the power to reverse the lower court’s decision and/or order a new trial. The appellate court may also consider issues that were not addressed in the lower court, including constitutional issues. If the issue is related to the law, the appellate court may decide to provide guidance to the lower court on how to properly apply the law or make a legal ruling on the issue. In Nebraska, appellate court decisions are considered binding on all lower courts. This means that if the appellate court decides that a lower court made a mistake in its decision, the lower court must adhere to the decision of the appellate court and cannot make a different ruling.
