What is the scope of review for an appellate court?

In South Carolina, appellate courts review the decisions of the trial court and determine whether the trial court made any errors in their ruling. When an appeal is heard in an appellate court, the scope of review is limited to examining the law and the evidence that was presented to the trial court. The court does not re-examine the evidence presented at the trial, nor does it determine the facts of the case. Instead, it determines whether the trial court was correct in its application of the law and whether it made any errors in its findings of fact or conclusions of law. Additionally, the appellate court determines whether the trial court followed court procedures and whether the ruling was reasonable. Appellate courts may also consider questions of constitutionality and procedural errors. For example, if a trial court ruling was based on a statute that was found to be unconstitutional, the appellate court would reverse the trial court’s ruling. The ruling of the appellate court is final, and a dissenting opinion may be filed if any members of the court disagree with the majority. The only exception to this is when an appeal is brought before the Supreme Court of the United States, where the ruling may be reviewed by the Supreme Court.
