What is an interlocutory appeal?

An interlocutory appeal is an appeal of an intermediate order or decision made before the case is resolved. In the state of Montana, an interlocutory appeal may be taken by either party to a legal dispute in an appellate court. The purpose of interlocutory appeal is to provide a practical and timely way to address issues that may arise during the course of a long legal process. If a decision has been made that may have a major impact on the case or a party’s rights, it can be appealed right away instead of waiting until the full case has been litigated and a final judgment has been handed down. In a civil suit, an interlocutory appeal may be taken from any non-final order or decree. This includes any order involving the rights or liabilities of the parties, any order for the payment of money, or any order involving equitable relief. In the state of Montana, only the Supreme Court may hear interlocutory appeals. These appeals are always heard by all of the justices on the court, so it is important that the party appealing the ruling has a strong argument. The Supreme Court may decline to hear the appeal if it is determined that the appeal is not of sufficient importance or complexity to warrant review before the entire court.
