What are the time limits for filing an appeal?

In Maryland, an appeal in appellate law must be filed within 30 days of the date of the final judgment, order, or other final action being appealed. This 30-day time limit can be extended if there are extenuating circumstances, such as a buyers’ remorse period or a delay in the mail. The time for filing a Notice of Appeal in the Court of Special Appeals is governed by Maryland Rule 8-204. In criminal cases, it requires that the notice be filed within 10 days from the date of the judgment or sentence. The time can be extended to 30 days with good cause. In civil cases, the time limit is ordinarily 30 days from when the lower court enters judgment or order unless the court has set a specific time limit that is shorter. If that is the case, the notice of appeal must be filed within that set time limit. In appeals from the Circuit Court to the Court of Special Appeals, parties must also file a brief and exhibits with their Notice of Appeal. The time to do this is often set by the lower court and briefs and exhibits must be filed within that time limit or within 30 days, whichever is shorter. It is also important to note that in Maryland, some appellate decisions can be appealed directly to the Maryland Court of Appeals. In order to do so, a party must file a petition for a writ of certiorari within 30 days after the decision of the Court of Special Appeals is issued. This time limit cannot be extended.
