What is the process for obtaining an appellate court review of a trial court’s decision?

The process for obtaining an appellate court review of a trial court’s decision in California is done by filing an appeal with the appellate court. First, the appellant (the person or party appealing the trial court’s decision) must file a Notice of Appeal with the trial court and provide a copy to the respondent (the person or party responding to the appeal). The appellant must pay fees required by the appellate court and file a copy of the notice in the appellate court within a certain time frame (usually 30 to 90 days after the trial court judgment). After the notice of appeal has been filed, the appellant must complete and file a Record on Appeal. This includes providing transcripts of the trial court proceedings, briefs, and other documents that the appellate court might want to review. Upon completion of the Record on Appeal, the appellant may make written arguments to the court. This is usually done either through a written brief or oral argument before the appellate court. The appellate court then has the opportunity to review the trial court’s decision and determine whether or not to modify or reverse the trial court’s decision. The court’s decision will be written in a document called an “opinion”, which is a legal record of their decision.
