What is the process for obtaining an appellate court review of a trial court’s decision?

In Florida, the process for obtaining an appellate court review of a trial court’s decision begins by filing a notice of appeal with the trial court. The notice of appeal must be filed in the trial court within 30 days after the trial court enters final judgment on the case. Along with the notice of appeal, the party seeking appellate court review must also file a “record on appeal” and a “brief” with the trial court. The record on appeal is a compilation of all the documents, reports, transcripts and exhibits that were presented to the trial court before and during the trial. This record is then shared with the appellate court. The brief is a written document that explains why the party believes the trial court’s decision should be reversed or modified. Once the appellate court receives the notice of appeal, record on appeal, and brief, the appellate court will issue an order of acceptance or denial of the appeal. If the appeal is accepted, a “Schedule of Briefs” will be issued. The Schedule of Briefs outlines the due dates for filing appellate briefs and supporting documents with the appellate court. The appellate court will then review the appeal and issue a decision. This decision may reverse, modify, or affirm the trial court’s decision.
