What is the scope of review for an appellate court’s decision?

In Mississippi appellate law, the scope of review for an appellate court’s decision is the standard by which an appellate court will measure a lower court’s decision. It is the responsibility of the appellate court to review the evidence and the law presented to the lower court and to decide if the lower court made an error in decision or application of the law. Generally, the scope of review for Mississippi appellate courts is limited to determining whether the lower court committed an error of law, whether the evidence supports the judgment, and if the lower court abused its discretion. Appellate courts may also review the lower court’s fact-finding process, or the weighing of the evidence, to ensure that it was done properly. Generally, appellate courts will not substitute their own opinions or judgment for that of the lower court when determining the appropriate facts. They will, however, still review the evidence to ensure that the lower court properly weighed and considered it in reaching its decision. Finally, the appellate court can also determine if the lower court was correct in its interpretation of the law. The appellate court can overrule or modify the lower court’s interpretation if it is found to be erroneous. Ultimately, the scope of review for an appellate court’s decision is to determine if the lower court committed any errors that may have affected the outcome of the case.
