What is the appellate court’s jurisdiction over a case?

In Nebraska, the appellate court has jurisdiction over a case when it is appealed from a lower court to review the lower court’s decision. Appellate law in Nebraska is governed by the Nebraska Appellate Rules, which outline all aspects of appellate procedure. The appellate court’s jurisdiction is limited to the review of a lower court’s decisions. The appellate court may affirm, reverse, or modify the lower court’s decision, but it cannot create a ruling or otherwise issue a first instance decision. Appellate courts are usually not bound by the same rules of evidence and procedure used in lower courts and may consider documents that were not presented in the lower court proceedings. The appellate court may also decide a case based on facts and law that are not part of the record of the lower court proceedings. In some cases, the appellate court may order a new trial or hearing. When the appellate court reverses a decision, it generally remands, or sends, the case back to the lower court for further proceedings. Appellate courts may also enter an injunction or stay a trial until the appeal can be heard. Finally, appellate courts often have the power to issue original writs. A writ is a court order to a public official or other court to do or not do something.
