What is the process for filing a petition for writ of habeas corpus?

In New Hampshire, a petition for writ of habeas corpus is a legal document that can be used to challenge the legality of someone’s detention or imprisonment in state court. To initiate the process, the petitioner must file paperwork with the New Hampshire Supreme Court. This paperwork includes a statement of facts and law that supports their claim that the detention or imprisonment is illegal. The petitioner should also include any evidence they have to support their claim. Once the petition is filed, the Court will review the claim and decide if it is valid. If they determine that the claim is valid, the Court will issue an order to the Respondent (which can include the state’s attorney general or district attorney) to answer the claims made in the petition. The Respondent then has the opportunity to file an answer to the petition that opposes the claims made by the petitioner. The Court will then hear oral arguments from both the petitioner and the respondent. During oral arguments, each side will present evidence and legal arguments to support their case. After hearing the arguments, the Court will issue a written opinion that either grants or denies the writ of habeas corpus. If the writ is granted, the Court will order the release or change of detention or imprisonment of the petitioner.
